Company Certification under F Gas Regulations after 4th July - 7/7/2009
DEFRA's F Gas support have issued the following statement on behalf of government regarding the 4th July deadline:
“Given the difficulties encountered in designating an appropriate certification body…. it is likely that there will be a number of companies who may not have received either an interim or a full certificate by 4th July 2009. Failure to hold a certificate will however be an offence under the GB F gas Regulations 2009. All companies should apply for their certificate as soon as possible and no later than the 4th July deadline.” (see
www.defra.gov.uk/fgas ).
When the certification body was designated in June ACRIB advised that companies (including sole traders) sign up for Company Certification before the 4th July. Where circumstances have meant that this has not been possible it is now recommended that companies make all reasonable efforts to get a Company Certificate and keep a record of these efforts so that they will be able to demonstrate that they have taken action. Company certification bodies appointed by DEFRA are still taking applications from companies on their systems who do not have all of the necessary information to hand whilst they sort out any personnel qualification issues, although they will not be able to issue Certificates until all the details are obtained. The 4th July was an important deadline, but passing this date should not deter companies from registering now - later is better than not at all! It is illegal to carry out installation or maintenance work on RAC equipment containing HFCs without a Company Certificate – and it is vital that companies respond to this requirement.
